联盟伦理审查委员会正式发布《临床试验受试者权益保护与伦理审查操作规范(2025版)》(以下简称"新规范")。新规范历经18个月的起草、研讨与修订,广泛征集了来自临床研究机构、法律界、患者权益组织及监管机构的意见,是联盟成立以来在伦理规范建设方面最具系统性与前瞻性的重要文件。
新规范的发布填补了联盟在临床试验伦理审查操作层面的制度空白。委员会主席叶承恩教授在发布会上表示,随着基因治疗、细胞治疗等新型干预手段的迅速发展,以及跨国多中心临床试验日益普遍,传统伦理审查框架面临前所未有的挑战,新规范正是为应对这一现实需求而生。
新规范的主要变化
与2019年版旧规范相比,新规范在以下五个核心领域作出了实质性更新。
第一,知情同意程序数字化。新规范明确允许在特定条件下采用电子知情同意(eConsent)替代传统纸质签署,并对电子知情同意的技术标准、身份核验要求及撤回机制作出详细规定,以适应远程临床试验和去中心化试验(DCT)的现实需求。
第二,数据隐私保护强化。结合香港《个人资料(私隐)条例》及欧盟GDPR的最新要求,新规范对临床试验数据的收集范围、存储期限、第三方共享条件及跨境传输限制作出了更为严格的规定,要求所有研究方案在伦理审查申请时须附上数据隐私影响评估报告。
第三,弱势群体参与保护升级。新规范专设一章,针对未成年人、认知障碍患者、孕妇及处于紧急情况的受试者,分别制定了更为细化的知情同意替代程序与额外保护措施,并要求研究者在方案设计阶段即须提交专项风险评估。
第四,跨国多中心研究协调机制。针对亚太地区跨国临床试验中各参与国伦理审查标准不一、重复审查效率低下的问题,新规范提出了"主审流程—协审流程"的分层审查框架,允许联盟成员机构在满足一定条件时采用互认机制,显著降低跨国研究的合规成本。
第五,人工智能辅助工具的伦理要求。针对AI在受试者招募、数据分析及安全性监测中的应用日益增多,新规范首次对AI工具在临床试验中的使用透明度、算法可解释性及结果可审查性提出明确要求。
实施时间表
新规范自发布之日起进入六个月的过渡期,期间联盟将组织系列培训工作坊,帮助各成员机构的伦理审查委员会及研究团队理解并落实新规范的具体要求。过渡期结束后,所有向联盟提交伦理审查申请的研究项目须按照新规范执行,旧版规范同时废止。

The ZALSH Ethics Review Committee released the 2025 Guidelines on Clinical-Trial Participant Rights Protection and Ethics Review Operations. The new guidelines were drafted, discussed, and revised over 18 months with input from clinical research institutions, legal professionals, patient-rights organizations, and regulatory bodies.
The guidelines fill an operational gap in ZALSH?s clinical-trial ethics review system. Committee Chair Professor Ye Chengen noted that rapid advances in gene therapy, cell therapy, and multinational clinical trials require a more modern review framework.
Compared with the 2019 version, the new guidelines introduce five major updates. First, they permit electronic informed consent under defined conditions and set standards for identity verification and withdrawal mechanisms. Second, they strengthen data privacy requirements in line with Hong Kong?s Personal Data (Privacy) Ordinance and the EU GDPR.
Third, the guidelines add stronger protections for vulnerable groups, including minors, patients with cognitive impairment, pregnant participants, and emergency-case participants. Fourth, they introduce a lead-review and co-review framework for multinational multi-center studies to reduce duplicated ethics review across countries.
Fifth, the guidelines define ethical requirements for the use of AI tools in recruitment, data analysis, and safety monitoring, including transparency, explainability, and auditability.
The guidelines enter a six-month transition period from the release date. ZALSH will organize training workshops for member institutions, ethics committees, and research teams. After the transition period, all ethics review applications submitted to ZALSH must follow the new guidelines.
